CHIANTI, ITALY: HGTV show 'Fixer to Fabulous' hosts Dave and Jenny Marrs were sued by their customers, Matthew and Sarah McGrath, due to allegations of breach of contract and breach of warranty. The McGraths claimed that they entered into a contract with Marrs Construction and Jupiter Rentals, owned by Dave Marrs, for the purchase of a property in Bella Vista, Arkansas. The defendants were supposed to perform upgrades on the property, both before and after the purchase, but the McGraths alleged that the agreed-upon upgrades were never completed.

The lawsuit, filed on February 7, 2023 for $75,000, stated that the McGraths identified specific repairs and upgrades needed after multiple inspections of the property. These included tasks like installing missing cabinet hardware, repairing or replacing broken windows, and fixing hardwood floors. The McGraths claimed that, despite the contractual agreement, the defendants failed to perform these repairs, and the defects in their new home were worse than anticipated.

Furthermore, the McGraths alleged that attempts to communicate with Dave Marrs and his companies failed, and the defendants refused to perform the necessary repairs. The lawsuit sought damages for breach of warranty and contract, including attorney's fees and the costs associated with repairing the property due to the defendants' failure to fulfill their obligations.

In response, Jupiter Rentals and Marrs Construction denied some of the allegations, stating that the McGraths had prevented them from performing the necessary repairs by refusing access to the property. The defendants claimed that the alleged damages resulted from unavoidable occurrences and intervening causes beyond their control. The case went to mediation, which reportedly failed, and subsequent legal proceedings involved disputes over discovery responses and a motion to compel the defendants to produce proper responses related to the case.

A jury trial is scheduled for September 23, 2024, at the Benton County Courthouse. The McGraths are seeking judgment against Jupiter Rentals and Marrs Construction, attorney's fees, and the costs associated with property repairs.
