She along with two other women, Amber Lancaster, and Jaime Edmondson Longoria, filed a lawsuit against Platinum West and Platinum Plus Gentleme's club in South Carolina and Pennsylvania. In the documents, Heather added the image of the flyer used for "false advertisement." The flyer had the picture of Heather wearing a black skirt and pink jersey with the number 69 as she held the volleyball in her hand. The flyer used the phrase, "Cheerleaders for every fan."

Heather claimed in her lawsuit that the strip club used her image for "Sunday and Monday night football events." The three women also asked for a hefty amount for using the picture without consent.
