LOS ANGELES, CALIFORNIA: Kevin Costner's estranged wife Christine Baumgartner has reportedly been forced to vacate his residences after filing for divorce, owing to an ironclad prenuptial agreement. After 18 years of marriage, Baumgartner, 49, filed for divorce on Monday, May 1, citing irreconcilable differences, according to reports.
Baumgartner’s court filings listed their date of separation as April 11 and requested joint custody of their three children, Cayden, 15, Hayes, 14, and Grace, 12. The ‘Dances with Wolves’ star, 68, responded with his own filings in which he also requested joint custody of his brood. However, Costner’s filings also mention a prenup agreement that the couple signed at the time of their marriage in 2004. Under the terms of the prenup, Baumgartner is required to leave the premise of all properties that are owned by her soon-to-be ex-husband, according to Radar Online.

Baumgartner has a short time to pack her belongings and leave the properties. The ‘3 Days to Kill’ star, who has a net worth of $250 million, owns three luxurious homes solely in his name. "Under the terms in Paragraph 9.A. of the parties' Premarital Agreement, Petitioner to vacate Respondent's separate property residences,” Costner's legal team said in the court filing, according to People. They also filed a list of "separate property," including, "Miscellaneous jewelry and other personal effects; earnings and accumulations of Respondent before marriage, during the marriage, and from and after the date of separation; [and] there are additional separate property assets and obligations of each party as mandated by the parties' Premarital Agreement."

Before Baumgartner, Costner went through another divorce in 1994 when his first wife Cindy Silva filed for separation, which reportedly resulted in an estimated $80 million settlement. Costner and Silva’s 16-year-long wedding reportedly ended amid multiple reports that the actor had been having an affair with a celebrated hula dancer named Michele Amaral.
Reflecting on Costner’s latest divorce, his rep said in a statement, "It is with great sadness that circumstances beyond his control have transpired which have resulted in Mr Costner having to participate in a dissolution of marriage action. We ask that his, Christine's, and their children's privacy be respected as they navigate this difficult time." It also reported that Costner was left "stunned" when Baumgartner brought the papers as he was completely unaware of the impending divorce. “Kevin was very surprised by Christine’s actions, he obviously doesn’t want the divorce and he would take her back. It’s disappointing, he loves her and he loves his children,” a source told Page Six.
