Ferguson has been arrested for kidnapping and arson charges a few days after Kelley's car was found burned in a remote part of Dallas suburb Frisco, the Daily Mail reported. According to the affidavit, the vehicle was "burned beyond recognition and the incident was not consistent with a natural fire."

The affidavit for his arrest revealed that Ferguson, who was married, had been dating Kelley since the summer of 2022 under the fake name. After learning Ferguson's true identity and marital status, Kelley threatened to tell his wife about his infidelity in a message to Ferguson. Her aunt and coworkers, who said they hadn't heard from her in days, eventually reported her missing.

The Collin County Sheriff's Office is working with the district attorney to determine further charges against Ferguson. We believe the person responsible for her death is in custody," Sheriff Jim Skinner told WFAA, referring to Ferguson. Ferguson as per the affidavit had been dating Kayla since the summer of 2022.

Prior to the arrest Kayla as per the affidavit after learning about the affair had also told her friends that "she was going to blackmail 'Kevin.'"  Even investigators were told by her wife that she had received a text message from an unknown person on January 4. In the message, the person, she told investigators as per the affidavit had asked her to talk with her. It all occurred prior to the Fergusons' arrest as investigators were developing the case.

At the time, the investigators, the outlet mentioned, couldn't retrieve the phone number as Fergusons' wife's phone was "broken at the time."  Later Ferguson's vehicle was located near Kelley's residence in Collin County, according to the affidavit. Investigators found gloves, duct tape, and a blanket inside the vehicle.

Investigators interviewed Ferguson at his workplace on January 13, where he said he knew Kelley and that he last saw her on January 10 when she dropped him off at work around noon. Ferguson told investigators Kelley was supposed to drop off lunch for him at 6 pm on January 10 but that she didn't show up. According to the affidavit, Ferguson said his vehicle was near Kelley's residence "because he was hiding it from his wife."
