LOS ANGELES, CALIFORNIA: Oscar-winning actor Jamie Foxx, who is being sued for allegedly sexually assaulting a woman at a rooftop bar in New York City in 2015, has previously faced similar accusations over a claimed 2002 incident, but no further details were released about the accuser.

The current plaintiff, identified only as Jane Doe, filed the lawsuit anonymously in the New York Supreme Court. The alleged incident took place at Catch NYC's rooftop bar, Catch Roof, where Foxx was approached for a photograph by a friend of Jane Doe.

According to the complaint, Foxx, reportedly intoxicated, proceeded to make inappropriate comments to Jane Doe before allegedly physically assaulting her.

The lawsuit details how Foxx grabbed her arm, pulled her to a secluded area of the rooftop, and placed his hands on her waist, moving them under her crop top to rub her breasts, as per Variety

2002 allegations against Jamie Foxx

As per the reports, in 2002, Jamie Foxx "slapped" the accuser with his penis during a party at his Las Vegas home after she refused to perform oral sex on him.

The accuser from the 2002 incident came forward in June 2018, inspired by the #MeToo movement, expressing her desire to have the incident on record in case there were other victims. She reported the alleged assault to the Las Vegas Police Department, prompting an investigation.

A spokesman for the Las Vegas police told PEOPLE Magazine at the time, "On June 8, 2018, a female victim came to the LVMPD and alleged that a sexual assault occurred in the Las Vegas area in 2002 and named Jamie Foxx as the suspect. A report was taken and the incident will be investigated. Due to the nature of the crime, no further details can be released"

Legal response of Jamie Foxx to the 2002 allegations

In response to the allegations, Jamie Foxx vehemently denied the claims through his attorney, Allison Hart of Lavely & Singer.

"Jamie emphatically denies that this incident ever occurred, and he will be filing a report with the Las Vegas Police Department against the woman for filing a false police report against him," said Hart in a statement.

She added, "The first time [Jamie] became aware of this woman’s absurd claims about an incident that supposedly occurred 16 years ago was when TMZ contacted his representatives [Tuesday] about this story."

"The alleged incident was not reported to law enforcement in 2002, or at any other time in the last 16 years until last Friday because the incident never happened," claimed Foxx's attorney.

The current accuser, Jane Doe, seeks a jury trial and alleges that she suffered both physical and emotional harm as a result of the 2015 incident. As per the lawsuit, she endured severe emotional distress, anxiety, humiliation, embarrassment, post-traumatic stress disorder, and other physical and emotional damages.

To substantiate her claims, Jane Doe has filed her complaint under New York’s Adult Survivors Act, which provides a one-year window for sexual abuse victims to file claims that might otherwise be barred by time limits. Notably, this window is set to expire on Thursday, November 23.
