Khaldoun F: Man becomes first in Netherlands to be convicted for 'stealthing', gets three months

Stealthing is the act of secretly removing a condom during sex and is illegal in many countries

ROTTERDAM, NETHERLANDS: A 28-year-old man is now the first man to be convicted of secretly removing a condom during sex, though his sentence does not include rape. Khaldoun F, was handed a suspended three-month sentence by a Rotterdam court for "stealthing," though he had pleaded guilty to coercion. He had apparently removed the condom without warning his partner, who had been very clear that she did not want to have sex with him without it. The court had warned Khaldoun that he risked exposing the woman to “contracting sexually transmitted diseases and an unwanted pregnancy.”

Apart from the entitlement of removing his condom during the act, Daily Mail reported that he took it further by texting the woman later, saying, “You will be just fine.” While he has been convicted of stealthing, there was no question of rape as there was “agreement between the suspect and the complainant about the sexual penetration.”

Man gets three months

The coercion only related to the suspect’s failure to keep the condom on. The whole case hearing was considered a first because there are no laws in the Netherlands that cover penetration without a condom where consent had already been given for the penetration itself. Khaldoun was handed a three-month prison sentence, which also included a $1067 fine to be paid.

Another similar incident

While Khaldoun was handed a prison sentence and a fine by the Rotterdam court, the same court had cleared another man who had forgotten to put on a condom in the heat of the moment. Ruben R, 25, had said that he voluntarily asked his partner for a condom, but it had slipped his mind to put it on.

The difference between both the cases was that in the case of Khaldoun, the court had proof of intent to go through with the act, in the form of WhatsApp chats. However, in the second case, there was no intent to stealth.

The country's law does not offer any legal recourse for in cases of stealthing, making this the first case of this sort to be legally handled. There have been similar rulings in other European countries such as Germany, Switzerland and New Zealand. However, in England and Wales, non-consensual condom removal is considered rape and tried as such.
