Kaivon Washington: Suspect who 'raped' Madison Brooks and 12-year-old charged with third sexual assault

BATON ROUGE, LOUISIANA: Kaivon Washington, a teenager accused of raping LSU student Madison Brooks and filming her after the assault, has now been charged with sexually assaulting another woman in 2022. Besides Brooks and this woman, the 18-year-old was accused of raping a 12-year-old girl in 2020. 

According to charging documents in the Madison Brooks case, obtained by The Washington Post, Washington, 18, and a 17-year-old male have been charged with third-degree rape. Casen Carver, 18, and Everett Lee, 28, have been charged with principle to third-degree rape, which meant they were present but did not participate in the crime. Police reportedly said that Carver was heard laughing "callously" at Brooks after she was allegedly sexually assaulted. Washington was reportedly a high school varsity football player.

In the latest incident, the survivor said that Washington attacked her in October 2022, after meeting her at Reggie's, the same bar where he met Brooks on January 15. The survivor in the October case said that she asked if she could stay at one of Washington's "acquaintance's" apartments as she was too drunk to go home. The acquaintance has been identified as 18-year-old Karson Jones, according to Fox News

What happened to the survivor?

Washington's arrest affidavit reportedly said that all of them went back to Jones' home together. The survivor, whose age has not been revealed, alleged that at the house, both men forced her to have alcohol when she asked for water, and sexually assaulted her, according to the arrest warrant obtained by Fox News Digital.

Kerry Miller, the Louisiana attorney who is representing Brooks’ mother, Ashley Baustert, said that the accusations "accumulate and paint a disturbing picture." "There are a lot of similarities that suggest a MO," Miller said, adding, "It was the same bar, more than one man was involved, the use of alcoholic beverages being used and being separated from friends. … It suggests he preys on vulnerable women." 

What is Kaivon Washington's lawyer saying?

In a statement, Washington's lawyer Ron Haley said of the third arrest that there were "several concerns with the most recent charge." "First, like the matter in Livingston, the ‘follow-up’ investigation took place on or about Jan. 25, 2023," said Haley, referring to the time when the survivor reported the assault to the police.

"Secondly, the date of incident on Mr. Washington’s warrant is different from his co-defendant. Third, in the warrant for his co-defendant it does not mention anything regarding intoxication. It states the victim was having consensual sex with his co-defendant in the presence of Mr. Washington," the lawyer added. 

The date of the alleged rape is listed as August 1, 2022, in the original warrant, but police said that it was an error and that the date should have been October 1, 2022, instead. "Finally, the victim never accused Mr. Washington of having sexual intercourse with her, thus we are curious as to why he was charged with rape," Haley said.

The arrest warrant read that when they arrived at Jones' apartment, he said he would kick Washington out if he could not watch them have sex. The warrant reportedly said that while it was initially consensual, Jones allegedly "pinned her down and became increasingly aggressive, at which time she repeatedly told him to stop, and he repeatedly ignored her."

The survivor reportedly said "no" and "stop" multiple times and then asked for water. Washington is accused of bringing her alcohol instead of water and forcing her to drink it. Jones allegedly "grabbed her face and held her mouth open as Washington poured the drink down their throat," the warrant says. Jones continued to have sex with her while Washington watched, and later came and groped her. Washington later allegedly apologized to her in a text message. Jones and Washington were arrested and charged with first-degree rape. 

The rape and death of Madison Brooks

It was revealed that 19-year-old Brooks allegedly worked at the bar where she and the suspects had been drinking before the sexual assault, according to the New York Post. Police said that surveillance footage showed her entering the bar around 10 pm on January 14, when she did not appear to be working. She met the juvenile suspect at the bar and left with him in an intoxicated state between 1 am and 2 am on January 15, the day the alleged assault occurred. The three other suspects later got into the car and allegedly raped Brooks. She was then dropped off nearby and eventually run over by a ride-share driver. According to the autopsy, Brooks had "injuries consistent with previous sexual assault anally," as well as other injuries from the crash. Police said the driver of the vehicle will not be charged because he was not intoxicated. He also immediately called emergency services.
