'IT'S REAL CASH': TikTok coughs up $92M for data privacy settlement but how much will users get?
CULVER CITY, CALIFORNIA: The mega TikTok 'data privacy setllement' payout has reportedly begun as the users have started to post the screenshots of the mail verifying that sums totaling between $27.84 or $167.04 has been credited to their accounts on Thursday, October 27, as reported by Dataconomy.
Plaintiffs in the TikTok data privacy class action lawsuit for $92 million claimed that the defendants, Beijing ByteDance Technology Co. Ltd., TikTok Inc., formerly known as Musical.ly Inc., ByteDance Inc., and Musical.ly, now known as TikTok Ltd., had violated both state and federal law by using and collecting users' personal data in connection with their use of the app without providing adequate notice or consent.

TikTok has refuted all accusations of wrongdoing, and the court has not ruled in anyone's favour. Instead, in order to avoid the expenses and ambiguities related to putting the case to trial, the parties have reached a settlement.

How to claim your data privacy settlement?
The individuals who qualify for the data privacy settlement must fall under the Settlement class, which has two sub classes, National class and an Illinois class. "All Americans who used TikTok or Musical.ly before September 30, 2021" and "All individuals who reside in the State of Illinois and created videos using the TikTok or Musical.ly in the State of Illinois prior to September 30, 2021" will be eligible for a portion of the $92 million settlement. But here is the bad news — users would be able to file a claim up until March 2022 to be considered for a potential reimbursement, according to tiktokdataprivacysettlement — a deadline that has already passed.

The $92 million settlement is thanks to a class-action lawsuit alleging the company (TikTok) broke the law by harvesting personal data without consent. The aforementioned settlement would allocate $92,000,000 to pay for the administrative costs of the settlement as well as the legal fees and expenses of the identified plaintiffs and "Settlement Class Members" who make valid claims. It would also provide injunctive remedies to protect the data of App users. The settlement minimises the further expense and danger involved in pursuing the claims while compensating people whose rights the plaintiffs say were violated and absolving the defendants of further liability.
