Samuel Elliot: Indiana Uni student arrested for raping drunk co-ed as she vomited
BLOOMINGTON, INDIANA: An 18-year-old student from the University of Indiana has been charged with raping a female student from the same university in a dorm restroom. The victim informed police that she was drunk and was throwing up in the restroom when the incident took place. The accused, identified as Samuel Elliot, allegedly asked the victim to have sex with him in the washroom. The victim refused, stating that she was too intoxicated to consent. Elliot then proceeded to force himself on the victim while she was still puking and raped her. The incident took place about two months ago at the Teter-Thornton residence hall.
Samuel Elliot has reportedly turned himself in to the police. He was charged with a single count of rape and was booked into Monroe County jail. The victim, who has decided against revealing her name to maintain anonymity, told in an affidavit cited by The Herald-Times that she was initially unsure if she wanted to press charges against Elliot. The victim's friends convinced her to report the incident. One of her friends had even collected a used condom from the scene and preserved the object as evidence.

Judge asks rape victim if she closed her legs to stop assault
Court documents about the incident claim that seven students of the University, including Elliot and the victim, had been drinking on the third floor of the dorm lounge on December 2. After a certain point, the victim fell ill and lay down on the floor when Elliot started touching her inappropriately. She then went to the restroom to throw up when Elliot followed her and asked her if she would have sex with him. As per the information in the probable cause affidavit, the woman told Elliot that she was extremely intoxicated and was not stable enough to consent to sex. Elliot then allegedly dropped his pants down and raped the woman while she was still throwing up. The 18-year-old man also asked the victim to keep the incident a secret and walked her to her room.
The woman told police that she had confided in her friends after she came back to her room. Almost immediately after that, one of her friends went to the bathroom and found a used condom, which he picked up and stored in a plastic bag to preserve as evidence.
After a lot of persuasion from her friends, the victim finally decided to report the incident to the authorities on December 6. Her friends also turned in the preserved condom. Elliot's arrest was issued on January 20 and he was jailed only about a week later. Elliot was released from jail after posting 10% of his $25,000 bond. He will be appearing in court again on February 4.
