A woman accused of participating in the failed insurrection attempt at the US Capitol on January 6 asked a federal judge for permission to leave the country to go on vacation to Mexico later in February 2021 and got it. Jenny Louise Cudd went viral after she shared a recording of herself on Facebook Live being at the US Capitol.

A court filing on Monday, February 1, stated that her upcoming trip to Mexico was "planned and prepaid." The USA Today also reported that a US magistrate granted the request. According to The Washington Post, Farheena Siddiqui, an attorney representing Cudd, said of the four-day break in the Riviera Maya later this month, "This is a work-related bonding retreat for employees and their spouses."

Siddiqui also said, "Ms. Cudd has appeared at her scheduled court appearance, remains in constant contact with her attorney, and has remained in contact with pretrial probation, as ordered."

Cudd, a formal mayoral candidate from Midland, Texas, said in the Facebook Live she recorded while at the Capitol, "We didn’t vandalize anything but we did … break down Nancy Pelosi’s office door, and somebody stole her gavel." In 2020, Cudd actively participated in protests in Midland and Odessa against business closures and potential mask mandates having to do with the Covid-19 pandemic. Cudd owns a business herself called Becky's Flowers in Midland.

Cudd was arrested by the FBI on January 13 and faces two misdemeanor charges — entering and remaining on restricted grounds and disorderly conduct. Prosecutors reportedly took "no position" on her time-off request. In an interview with local news outlet NewsWest 9, she said that she did not "personally tear down anything, destroy anything, go in any offices, desecrate anything or commit any acts of violence", saying that "patriots" had already breached through Capitol's security and doors by the time she arrived and walked up the steps and went through the "open door."

She said during the interview, "I did not do anything illegal. I walked into an open door in the Capitol and went inside..." She also stated that no police or FBI officials had got in touch with her personally about arresting her.

The news of Cudd being granted permission to go on vacation to Mexico was met with uproar on social media, with many bringing up slain Capitol police officer, Brian Sicknick, who was recently lain to rest. One person tweeted, "Jenny Cudd, owner of Becky's Flowers in Midland, Texas, Brags She Entered the Capitol w/o permission to Engage in a Revolution with GOP Domestic Terrorists Who Killed an Officer. Her White Privilege now lets her vacation in Riviera Maya 2/18 as Officer Brian Sicknick is mourned." Another wrote, "This has really pushed me over the edge. She participated willingly and knowingly, and said she would do it again! Where are those DC judges at? #jennycudd goes to Mexico while we are watching #OfficerSicknick 's ashes delivered to the Rotunda. SICKENING."

San Antonio Mayor Julian Castro wrote, "One Texas woman is granted permission to vacation in Mexico after engaging in insurrection at the Capitol. Another was deported to Mexico after being a cooperative FBI witness to the massacre in El Paso. There are two systems of justice in America."
