Is abortion a constitutional right? Elizabeth Warren trolled for making claim

The Massachusetts Democrat was excoriated on social media for calling the SCOTUS 'extremist' and suggesting that abortion is a constitutional right

Sen Elizabeth Warren (D-Mass) faced quite the backlash for suggesting that abortion was a constitutional right that was being taken away by an "extremist" Supreme Court after a bombshell leak suggested the 1973 Roe v Wade decision would be struck down in the coming months.

Written in February 2022, the draft piece labeled 'Opinion of the Court' stated that the US Supreme Court has voted to strike down the landmark 1973 ruling, which legalized abortion in the United States. More than half of all states have some kind of abortion ban law set to take effect if Roe v Wade is overturned by the US Supreme Court.

"An extremist Supreme Court is poised to overturn #RoeVWade and impose its far-right, unpopular views on the entire country. It's time for the millions who support the Constitution and abortion rights to stand up and make their voices heard. We're not going back—not ever," Sen Warren tweeted.



 

Warren, a former law professor, was excoriated on social media for calling the SCOTUS "extremist" and suggesting that abortion is a constitutional right.

"See what they’re willing to do to protect the obvious legal fiction of a constitutional right to abortion? The ugliness of their assault on Justice Kavanaugh 3 years ago was just a prelude to the vicious, widespread insanity that’s coming," conservative host Buck Sexton tweeted.

"The 'extremist' is the disgraceful leftist who undermined the integrity of the Supreme Court of the United States because Democrats are poised to get crushed in the midterm elections," journalist Kyle Becker added.

"Abortion is not a constitutional right. Abortion should never be paid for by the taxpayers. Abortion is the act in which a woman decides to kill her baby. PERIOD. Now they want this option even AFTER birth. THEY ARE SERIOUSLY SO EVIL," conservative activist Julie Snark wrote.

"Abortion is not a Constitutional right. It’s not even a fundamental right. It’s murder, so by definition, it’s no right at all. I’m so sick of ignorance masquerading as virtue," one Twitter user wrote.

"I don't know who needs to hear this, but the Constitution doesn't mention abortion one single time. It's literally NOT a constitutional right. If Roe v Wade is overturned, it doesn't make abortion illegal. Overturning R v W simply returns the decision to the states," another offered.

"Civics 101 Note: Overturning Roe because it's not actually a Constitutional right doesn't ban abortion. It means the issue of abortion is a state issue. Whatever side you fall on, your state governments are the ones you need to be voicing your opinions to," someone else added.



 



 



 



 



 



 

It's worth noting that while Americans enjoy certain fundamental liberties that are protected by the US Constitution, the right to abortion is not one of them. The Bill of Rights helps balance individual rights and majority rule by allowing the majority to pass legislation via elected representatives. The decision in Roe v. Wade is an example of such legislation passed by pro-choice SCOTUS judges, according to a study in the National Library of Medicine.
