Convicted sex offender Brandon Scott Price, 28, was given two options after he sexually assaulted a female inmate: join the Army or go to jail. Price was given the choice by Judge Thomas Wingate during his sentencing hearing in Franklin Circuit Court last week.

The Judge handed down a 12-month sentence that is probated for two years, telling Price that he had only 30 days to enlist in the US military. “If you don’t enroll in 30 days, you can report to the Franklin County Regional Jail,” Wingate said. “You are under the gun, young man. You gotta do it.” “You’re getting a huge break,” Wingate said during Price’s sentencing. “You made a terrible mistake, which I know personally cost the county money.”

Back in July 2019, a female inmate filed a lawsuit in federal court against the county and several FCRJ personnel, claiming that Price, a jail guard, had sexually assaulted her the same year. The other FCRJ personnel named in the lawsuit were then-Jailer Rick Rogers and Capt. Wes Culbertson. The lawsuit claims that Price found that the female inmate's blood pressure had increased, following which he was asked to take her to the emergency room. “Though Price’s shift was near its end, Price volunteered to transport (the inmate) to the hospital,” the lawsuit states. “Price transported (the inmate) alone, in violation of Jail policy and industry standards and practices.”

The suit says that Price stayed with the inmate for as many as five hours at Frankfort Regional Medical Center, and made “sexually-charged comments”. He allegedly told her that he had connections with a Kentucky Department of Corrections (KDOC) employee who was responsible for parole decisions.

The woman was treated for high blood pressure at the medical facility, following which she was discharged. The inmate claimed that on their way back to the jail, Price forcefully held her in the back of the jail van. She also accused Culbertson of seeing her alone with Price and yet doing nothing. Price later told the inmate that “Culbertson almost caught him". Price and the inmate then left the hospital.

“On the way back to the jail, Price turned on Big Eddy Road and stopped the van,” the lawsuit states. “He turned around and told (the inmate) if she performed oral sex on him, he would talk to the KDOC employee he knew about getting her released from jail earlier.” Price then allegedly got back in the van and sexually assaulted the woman. The woman clearly claimed that she did not consent to the sexual act. 

When questioned, Price denied having made the inmate perform oral sex on him. However, he said that he “made a stupid mistake … I let a female inmate touch me inappropriately." Price was arrested and posted a $10,000 bond.
