Who is Erik Estavillo? Sex addict sues Twitter, AOC and Ilhan Omar over ‘pain and suffering’ due to Trump ban

Estavillo also insisted that he will sue other social media platforms that have banned the president

A self-described California sex addict has reportedly sued Twitter, representatives Alexandria Ocasio-Cortez, and Ilhan Omar over the “overbearing pain and suffering” after Donald Trump was indefinitely banned by the social media platform. Erik Estavillo filed the 11-page suit in the Northern District of California, The New York Post reported, in which he has asked for $88.7 million in compensation, the reinstatement of Trump’s account, and a retaliatory ban of both AOC and Omar. Estavillo has accused Ocasio-Cortez and Omar of using Twitter to “promote eastern communist philosophies.”

Estavillo, who is representing himself in the case, mentioned in the legal document that “this is unconstitutional when taken as a whole in regards to the limiting of certain free speech while allowing other controversial free speech to go unchecked, given that Twitter is now acting as Publisher and not Host of such content. Twitter is officially now operating as a ‘Virtual Company Town’ where all voices are heard and political ideas exchanged. This should occur on its platform without fear of banishment from such a Publisher as Twitter, and now they should be held accountable to such a standard as previous U.S. Case Law demonstrates that they are now operating as a Virtual Company Town.”

The lawsuit filed by the notoriously litigator, who earlier sued Twitch over masturbation injuries, also claimed in the filing that he ran for Congress last year and said because of his illnesses -- that include depression, agoraphobia, Crohn’s disease, and OCD - he has no friends and is dependent on social media as his only way of participating in political discourse. “The Americans with Disabilities Act should protect him from such egregious behavior on the part of Twitter. He has nowhere else to voice his first amendment rights to free speech,” the suit added. Estavillo also insisted that he will sue other social media platforms too that have banned the president.

In the suit, Estavillo also said that AOC and Omar should be banned on Twitter because their agitational posting style and public personas have harmed his “psyche”. The man went on to say, “AOC even has a white boyfriend but would never think of dating a Mexican like the plaintiff. They’re hypocrites.” While attacking Omar, he talked about her recent Twitch appearance, where her computer system seemed “highly expensive,” something that “most poor and disenfranchised people can’t afford, even before the COVID-19 pandemic.”

Though AOC and Omar did not respond to the suit, the former tweeted, “Bless their heart”, in response to the bizarre news. Others on internet too responded as one user commented, “Why am I unsurprised this is the same guy who tried to sue female Twitch?” Another one said, “LOL that case is gonna get thrown out super quick because all they need to do is read the TOS and realize that everyone had to agree to those before making their account. Time to laugh at the dumbasses who think it'll work!”



 



 



 

“So one of the reasons he's seing says "his followers are going through emotional stress without it." Does that mean we can sue him for emotional stress over his account inciting violence?” the third user questioned while the fourth one added, “Aspiring comedian, perhaps? Because otherwise if you're literally suffering because someone else's Twitter account is gone, get some psychiatric help!”
