Jurist loses his cool with killer Francisco Daniel Aguilar's unrepentant attitude
SALT LAKE CITY, UTAH: An infuriated judge squalled at a killer boyfriend for showing no penitence after fatally shooting his partner in the skull as she lay helpless on the street.
Judge Marvin Bagley has imposed a sentence of 25 years in prison for Francisco Daniel Aguilar, 18, for murdering his girlfriend Jacqueline 'Jacky' Nunez, 16, on January 8 in Utah.
According to Utah State Courts, Bagley was appointed to the Sixth District Court by Governor Jon M Huntsman Jr, and took the oath of office in January 2009.
He serves Garfield, Kane, Sanpete, Sevier, Piute, and Wayne counties. After receiving a law degree from Brigham Young University's J Reuben Clark School of Law in 1985, he served as a member of the Law Review and Order of the Coif.
The defendant had no justification for his crime
Aguilar, who was a sophomore at Piute High School when he committed the crime, was repeatedly questioned why he executed Nunez, but he answered impassively. "I acted stupidly and out of anger," he said, Daily Mail reports.
The judge lost his temper and replied, "Is that the best you can do?", adding that at least he could have given a proper explanation to the grieving family.
Judge Bagley previously impelled Aguilar on his motivation for claiming the life of Nunez, but the blank-faced 18-year-old just said there was no justification for what he did.
"We all know that, we just want to know the reason why", the judge urged. "I acted impulsively, irrationally, out of anger and I regret it every day of my life", Aguilar told the court.
Aguilar alleged he wanted to scare Nunez
The defendant also claimed that he only intended to scare his girlfriend and not kill her.
However, his claims were immediately shot down by the judge who laid out Aguilar's premeditation of bringing his father's 9mm gun and bullets when he drove Nunez to a remote area about 200 miles south of Salt Lake City.
Why was Nunez killed?
After taking her at Doc Springs Road about four miles north of Circleville, Utah, the couple allegedly got involved in a heated exchange.
According to The Sun, Nunez's friend, McKall Taylor, about the victim, and arrived amid the fight.
But when Nunez tried to leave with her, Aguilar reportedly started firing rounds at both of them.
While Taylor managed to escape the scene as Aguilar shot at the truck, Nunez was unfortunately shot in the leg which shattered her femur.
The cold-hearted killer then shot Nunez in the head and killed her after he found her wounded and helpless on the ground. He was arrested later that evening in January.
What charges does Aguilar face?
Aguilar had pleaded guilty to all five charges, first-degree felonies aggravated murder, attempted aggravated murder and a felony discharge of a firearm and two counts of aggravated assault, which are a second-degree felony.
On Monday, August 28, Judge Bagley handed him the maximum sentence after Nunez's family delivered heart-wrenching victim impact statements.
What did the victim's family members say?
According to local media outlets, Jacqueline Nunez's sister Rosa Nunez said that her sister's murder was a "life sentence of suffering" for her family and said Aguilar's actions were "unforgivable and pure evil."
Nunez' mother Irma said that her daughter did not deserve what Aguilar had done and that it left an 'immense hole' in her heart.
Her other sister Mayuni Nunez shared with the court, "I often have to remind myself that this nightmare is real and I am awake, this is the reality of our lives. I just want everyone to please pray for us so that we may obtain the strength needed for this life-long battle we're in."
