Vegan woman sues neighbor over smell of meat and fish from barbequing in their own backyard: 'I haven't been able to sleep'
An enraged vegan woman took her neighbors to court because of the smell of meat emanating from their barbecue wafted into her garden causing her distress.
The woman, identified as Cilla Carden, from Australia, said in her complaint that she cannot enjoy her own backyard because of the smell of meat and fish coming into her garden, which she believes is cooked "deliberately" in an attempt to irritate her.
"They’ve put it there so I smell fish, all I can smell is fish... I can’t go out there," Carden, a massage therapist, while talking to Nine News, said. Reports state that she has been embroiled in a battled with her neighbor Toan Vu, his wife, and his children since late 2018.
Carden reportedly applied to the Supreme Court of Western Australia for the right of appeal after her claims were rejected by a tribunal court earlier this year. However, the high court turned down her appeal in July.
Commenting on the case, lawyer John Hammond said that going to the Supreme Court was an “extreme option." However, that did not stop Carden from appealing the case further. She said she believed that her neighbors were "absolutely deliberate” in allowing the smells of their barbecue to cross into her yard. Carden added that she was not just annoyed by the smell of meat, she was also furious over the smell of cigarettes and the sound of children playing with basketballs from the neighboring house.
“It’s been devastating, it’s been turmoil, it’s been unrest, I haven’t been able to sleep,” Cilla said.
Meanwhile, Vu, in his statement said that he just wanted to "keep the peace" and had removed the barbecue from his yard. He reportedly even banned his children from playing basketball.
Reports state that Cadern had also complained about the neighbor who lives on the other side. The neighbor, on conditions of anonymity, said: "Ms Carden’s demands were proven to be not reasonable and indeed were to the detriment of the other owners’ ability to enjoy their lots in a reasonable and acceptable manner.”
Despite the measures taken by Vu, Cadern has vowed to continue the legal battle against them.
