PHOENIX, ARIZONA: Donald Trump's former senior adviser Stephen Miller's America First Legal Foundation has become a focal point in the legal battle against transgender-inclusive policies, exemplifying a contentious narrative within the education system.

The foundation, under Miller's presidency, recently launched a lawsuit against Mesa Public Schools in Arizona, targeting their policies, which are supportive of transgender students.

Lawsuit accuses violation of laws regarding parental rights

The lawsuit alleges that these policies, aimed at providing a safe environment for transgender and gender nonconforming students, violate parental rights laws in Arizona, according to AZCentral.

It specifically challenges the district's approach, contending that it prohibits parental notification regarding a student's gender identity and facilitates their transition without involving parents.

According to America First Legal, such policies defy multiple statutes, including Arizona's Parents’ Bill of Rights, asserting the right of parents to oversee their children's upbringing, education, health care, and mental health.

“This case involves an astonishing situation that once would have been unthinkable: a school district policy to assist and encourage students who want to represent themselves as having a gender different from their biological sex, and which forbids the notification of parents,” the lawsuit says.

It adds, “The policy directly violates multiple statutes, especially Arizona’s Parents’ Bill of Rights, which recognizes and protects the ‘fundamental right’ ‘of parents to direct the upbringing, education, health care and mental health of their children.’”

The lawsuit claims that the district's protocols breach statutes mandating parental consent for discussions on sexuality and mental health screenings for minors.

Lawsuit illuminates tension between transgender support and parental rights

The legal action taken by Miller's organization spotlights a growing conflict between those advocating for inclusive measures for transgender students and groups opposing what they perceive as an infringement upon parental rights.

The lawsuit questions the legitimacy of the district's policies, emphasizing that the governing board never "voted to adopt any such policy."

Mesa Public Schools' policies allow transgender students to utilize facilities corresponding to their gender identity and to use chosen names and pronouns.

Additionally, the district requires staff to inquire whether students wish to involve their parents; if students decline, the district respects their wishes.

Rachel Walden, a board member involved in the lawsuit, has openly opposed the district's guidelines concerning transgender students since her appointment in January.

The district sought legal counsel, which concluded that their policies were not in violation of state law.

Superintendent Andi Fourlis reiterated that parents are informed about support plans for transgender students and clarified that medical transitions were not part of these plans.

America First Legal's push against transgender-supportive policies

The lawsuit filed by America First Legal seeks to nullify the district's transgender-supportive policies and prevent the implementation of any related measures without the board's explicit approval.

It demands parental notification and consent when students express concerns about their gender identity or wish to transition, ignoring the potential risks posed to students whose parents may not be supportive.

Founded in 2021, America First Legal positions itself against what it to be the radical left's agenda, citing opposition to anti-jobs, anti-freedom, anti-faith, anti-borders, anti-police, and anti-American sentiments.

Stephen Miller, supported by Gene Hamilton, a Department of Justice member during the Trump administration, spearheads the foundation's legal initiatives.

The lawsuit against Mesa Public Schools is just one among several legal battles America First Legal has initiated, targeting LGBTQ+-supportive practices in various spheres, echoing Miller's opposition to policies he views as detrimental.
