Joe Giudice can't return to US as court rejects appeal, here’s why the 'RHONJ' star was deported to Italy
'The Real Housewives of New Jersey' star Joe Giudice has been denied the appeal against deporting him from the US to Italy. According to the latest reports, the United States Court of Appeal For the Third Circuit has ruled out the petition submitted by the 47-year-old on November 21, 2019.
The order states, “This cause came to be considered on a petition for review from the Board of Immigration Appeals and was submitted on November 21, 2019. On consideration whereof, it is now hereby ORDERED and ADJUDGED by this Court that the petition for review of the decision of the Board of Immigration Appeals entered on April 11, 2019, is DENIED. All of the above in accordance with the opinion of this Court.”
Although the reality star has been forced to return to Italy, he has always maintained that he belongs in America and deserves citizenship. He was deported to his native country, Italy, following 41-months in prison on charges of mail, wire and bankruptcy fraud. However, there’s more to his story and several reasons why he was being deported to Italy in the first place.
Although Guidice has lived in America for the majority of his life, he isn’t documented. The US law clearly states that immigrants can be adopted from the country if they are convicted of a crime of any sort, which is true in Giudice’s case. He himself accepted that he failed to obtain citizenship when he said, “My parents are citizens. My brother and sister are citizens — they were born here. I just never thought to file for citizenship.”
According to the current US immigration laws, Giudice would have received citizenship had he been younger than 21 years when his parents were declared citizens. However, in his case, he was well over 21 when his parents got approved to live in the US. He was born in Saronno, Italy, and brought to the United States by his parents when he was only a year old.
The latest order by the court means he won’t be able to ever return to the US and reunite with his four daughters.
On February 14, an overwhelmed Giudice took to Instagram to reflect on his mistakes, as he shared a picture captioned, “You are not here, but there is evidence of you all around me. I am struck with how lucky I am to receive the gift of your love and affection every single day. I know I mess up a lot. I embarrass, get distracted, don’t listen to the things you ask me. But, you forgive me. Every time. You tell me that it’s ok and that you love me. There is no keeping track of the things I did that hurt your feelings, or the things that I went wrong on cause of me. You’ve loved me at my worst and it has changed me for the better as a father."
