A Montana woman has been charged and sentenced to a maximum penalty of 20 years in state custody after she broke into her ex-boyfriend's home and forced him to have sex with her while holding a machete over his neck.
According to court records obtained by the Smoking Gun, a 20-year-old woman named Samantha Mears was charged in relation to the arrest in 2018 for sexually assaulting the victim in Great Falls. Her attack has landed her into the custody of Montana’s Department of Public Health and Human Services, through which she will be placed in a mental health facility.
Mears' case was put on hold in June 2018 after she was said to be unfit for the trial. She was treated at the Montana State Hospital following which she was declared stable enough to proceed with the case. However, it is reported that her sentencing order says that she "suffers from a mental disease or defect." She is also registered as a Tier II sex offender for the felony she committed and has been ordered to undergo counseling.
According to the probable cause affidavit, she broke into the man's home while he was out to the gas station and on his return, came out from her hiding place behind the bedroom door "behind him and placed a machete under his throat." She then asked him to "get on the bed and remove his clothes." She then proceeded to "removed her pants and crawled on top of him". The man told the police that they had sex after he had become aroused upon seeing her without her underwear. After ejaculation, he had tried to push her off, but she had refused to stop and continued to have sex with him till he was no longer erect.
After the act, she had continued to sit on his bed armed with the machete, the document said, with her back against the wall. An argument ensued and she urinated on his bed. He called 911 eventually and faked the call as phoning a friend named Doug. When the police arrived, she was still armed with the machete. Two months before the sexual assault, the woman was arrested for strangling her boyfriend, the outlet reported.
