White Florida realtor pointed gun at Black homeowner, accused him of 'stealing' flyer from his OWN mailbox
MIAMI-DADE COUNTY, FLORIDA: A White man has been arrested and charged after he allegedly pointed a gun at a Black homeowner and also accused him of stealing a flyer from his own mailbox. Joseph Max Fucheck is accused of making racist remarks on Dwayne Wynn and also telling him that the Miami-area home does not belong to him, and stated: “'This is why you people get shot”.
Miami-Dade State Attorney Katherine Fernandez Rundle said on Tuesday, June 30, that the 58-year-old accused has now been charged under the state's hate crime law. He now faces charges of aggravated assault with a firearm with prejudice and possession of a firearm by a convicted felon. Both are second-degree felonies. “It is sad that racism can turn the most mundane act into a confrontation with potentially violent overtones,” Rundle said in a statement.
The alleged incident happened on June 14. The victim was reportedly speaking with a neighbor outside his home when Fucheck came to the location in his SUV, put a flyer in Wynn’s mailbox, and drove away, investigators said as reported by The Daily Mail. As the accused drove away, Wynn walked across the street to check his mailbox. The flyer was for Fucheck's real estate business that read: “We Buy Houses…CASH!' and 'We Buy Houses… FAST!”
After checking the card, Wynn again reportedly went back to his neighbor to talk. But by that time, Fucheck came back in his vehicle and began yelling obscenities at Wynn. He accused the victim of stealing, despite being told that the house and the mailbox, both belong to Wynn. Investigators stated that Fucheck then took out his gun and demanded the flyer back while pointing the gun at Wynn. The alleged altercation was recorded by the victim on his cellphone camera. “That's not your property motherf*****! I saw you! I was down the street watching you! I saw you take that out of there. You're just a motherf****** nosy neighbor! Give me my card, that's my property!” Fucheck yelled. “Damn right I carry a motherf****** gun,” he said as he continued to wave the gun. The suspect also accused Wynn of not owning the property.
Authorities said that in the video, Fucheck was heard using racist slurs and claiming “this is why you people get shot” before he drove away. The episode was reportedly witnessed by a number of people, including children. “After speaking with all the involved witnesses and reviewing the evidence, we are alleging that but for the fact that Mr Wynn is a Black male, the entire incident would not have occurred,” Rundle said in the statement.
She added: “All Mr Wynn wanted to do was go into his mailbox for his mail. Suddenly, as the video shows, Mr Fucheck accosted him with a barrage of ugly statements and racial slurs. This incident was about much, much more than the obnoxious behavior of an irate man arming himself and screaming at someone he did not know and had no reason to fear. With this arrest, we are alleging today that the incident was about hate and intimidation, pure and simple.” Miami-Dade Police Department Director Alfredo Ramirez said in the statement: “There is no place in our diverse County for hate and the violence that too often spawns from it.”
