Teen gamer arrested after another gamer heard cries of a girl he was sexually abusing while playing on PlayStation
18-year-old Daniel Enrique Fabian was arrested on November 21 and was subsequently charged with lewd and lascivious battery on a victim between the age of 12 and 15
While he was in the middle of a Grand Theft Auto game, 18-year-old Daniel Enrique Fabian told another player that he would be gone for a couple of minutes so that he could "smash" an underage teen girl who was coming to his house, the authorities have said. A police report says that Fabian's PlayStation microphone managed to record him raping a 15-year-old girl. It was reported that the other player heard the whole thing because the teen forgot to turn off the microphone.
ABC Action News reported that the authorities have said the rape took place in June at Fabian's home which is in New Port Richey, Florida. According to Fox 13, Fabian was arrested on November 21 and was subsequently charged with lewd and lascivious battery on a victim between the age of 12 and 15.
Fox 13 reported that Fabian had been playing Grand Theft Auto and was talking to another player on a multiplayer network on the same day of the reported sexual assault. The authorities have said that the teen was away from the game for about 15 minutes.
According to WTSP, the other player said he heard a female voice yelling out "No" multiple times during that time. The authorities said that the victim, who has not been named, told them that Fabian covered her mouth and forcefully held her down on his bed as she tried escaping four different times.
The other gamer told ABC Action News that he heard the victim moaning for help. As noted by WFLA, it is still not known if the other player reported Fabian. The authorities have said, however, that it is still unclear if the other player reported Fabian in the game.
The authorities have said that the girl had some DNA evidence on her thigh and it confirmed that Fabian was the one behind the attack. A sexual assault victim exam also came back positive for sexual assault. After he was arrested, Fabian was taken to the Land O'Lakes Detention Center where he is currently being held.
The authorities have said that this isn't the first time that technology has been used to bring justice to the victims in similar cases. In October this year, two men from Tennessee were indicted after investigators said that the mother of a 9-month-old baby girl found out that her infant had been raped after seeing a cellphone video of it. The mother instantly recognized one of the attackers.
According to Fox 13, the Shelby County District Attorney's Office said that the suspect was 19-year-old Isiah Dequan Hayes. It was also reported that 22-year-old Daireus Jumare Ice was the one behind the camera when the cruel assault took place in Memphis. The alleged rape was reported to the authorities in October 2016 after the infant's mother said she found the video.
Two years later, on October 10, 2018, the Shelby County District Attorney's Office announced that both of the men were indicted by a jury due to the accusations against them. According to WREG, the video showed a man, who was naked from the waist below, touching himself while near an infant. In February this year, the authorities said that Hayes has been arrested after he confessed to molesting the infant.
Aside from both of the men being indicted on a charge of especially aggravated sexual exploitation of a minor, Ice was also indicted for aggravated rape of a child (criminal responsibility for the conduct of another), and Hayes was indicted for aggravated rape of a child.
