Husband who chopped off man's penis after catching him raping his wife faces more prison time than the attacker

A Ukrainian man who chopped off a rapist's penis after catching him sexually assaulting his wife yards from their home faces a longer sentence than her attacker.

The 27-year-old husband, who was not named, was on his way home 10 minutes after his wife left the same party when he witnessed the horrific attack in Shevchenkovo, a village in the eastern Kharkiv region, Ukraine.

His wife, who was also not identified, was just 1,000 feet away from a restaurant where she had joined her husband to hang out with some friends. 

Dmitry Ivchenko, 25, attacked the woman from behind when she was walking near her apartment block at around 1 am.

In order to prevent her from screaming, he put his hand over her mouth before dragging her into the bushes, Daily Mail reported. 

When the victim's husband was near the house, he heard noises coming from the bushes. When he went over to investigate, he found Ivchenko squeezing his wife's throat while raping her. 

In a fit of rage, the husband attacked the rapist by punching him on the head. He then grabbed a Swiss knife that he carried with him and proceeded to chop off Ivchenko's penis. 

"The husband lost the ability to control his actions. He did not understand what he was doing," the husband's attorney Dmitry Spaskin said to local media.

The woman's mother reported the incident to the police after the attacker's screams and the victim's screams woke up the entire neighborhood. After the police arrived, the rapist was transported to a nearby hospital. 

Spaskin said that his client was not in control of his actions when he attacked Ivchenko. 

"After the incident, [the husband] was in a state of shock and just walked away," he said. "He walked about 13 kilometers and reached a neighboring village. There he met an acquaintance and asked to drive him to a police station. On October 13, at 7 a.m., he handed himself in and confessed in full."

Doctors have not speculated if they would be able to reattach Ivchenko's penis or if he will regain full functionality of the organ. "The patient needs a long-lasting treatment," they said. 

While Ivchenko remains in hospital under police surveillance facing a criminal case, the husband was charged with causing grievous bodily harm and was put under house arrest.

The husband faces up to eight years in prison if found guilty. On the other hand, the rapist Dmitry Ivchenko faces up to five years.
