FOUNTAIN, COLORADO: A 31-year-old Colorado woman who admitted to having sex with a 13-year-old child in June 2022 won't spend a day in jail. Andrea Serrano became pregnant as a result of the sexual assault on the minor, and it was later revealed. She was released on a $70,000 bond shortly after her arrest in July of last year.
The Fountain Police Department charged Serrano with sexual assault on a child by a person in a position of trust, as well as sexual assault on a child. Serrano, according to investigators, admitted to the relationship. In a deal that required Serrano to register as a sex offender but spared her jail term, the defense team for Serrano and the prosecution were said to have agreed on Friday. Serrano admitted to her crimes when asked by the Fountain Police Department. The Colorado Springs Gazette stated that the victim "looked at her like a mother figure and even called her 'mom' before," according to the criminal affidavit in the case. The victim's mother told KKTV that her son would have to live with the fact that he was a victim for the rest of his life.
The mother said, "I feel like my son is robbed of his childhood. Now he has to be a father. He's a victim, and he's going to have to live with that for the rest of his life." She further added, "I feel like if she was a man and he was a little girl, it would definitely be different. They would be seeking more. I feel like because he is not a woman, they are not. They are having compassion for her."
During her arrest, it was reported that Serrano and her victim had been living together for a while. According to the Gazette, the victim's mother expressed her anger to the judge in the case before the plea agreement was accepted. According to reports, Serrano's plea arrangement involves pleading guilty to less serious crimes. However, a judge may still sentence her to 10 years to life in "sex offender intense supervised probation."
The length of Serrano's probation will be decided at a hearing in May. According to the Gazette, the 'lesser charge' is the one of incest, a Colorado class four felony. Serrano has two more misdemeanor charges for breaking the provisions of a restraining order, and she is scheduled to appear in court in March before her probation hearing.
